1. Introduction and Acceptance of Terms

These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and HippolyteDev, a company incorporated under the laws of France ("HippolyteDev", "we", "us", "our"), governing your access to and use of the Kina mobile application (the "App"), including all features, functionalities, content, and services made available through it (collectively, the "Services").

By downloading, installing, registering for, accessing, or otherwise using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, together with our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately uninstall and discontinue use of the App.

We reserve the right to update, modify, or replace these Terms at any time in accordance with Section 25 of this Agreement. Your continued use of the Services following publication of any such changes constitutes your acceptance of the revised Terms.

2. Definitions

For the purposes of these Terms, the following definitions apply:

• "App" means the Kina Android application, including all software, code, interfaces, content, and features contained therein.

• "Services" means the App and any other products, features, tools, or content made available by HippolyteDev in connection with Kina.

• "Account" means the registered account you create to access the full functionality of the App.

• "User Content" means any text, images, audio, video, messages, translations, or other materials that you create, capture, upload, transmit, or otherwise submit through the App.

• "Tokens" means consumable virtual currency available for purchase through Google Play Billing that may be used to unlock specific features or content within the App.

• "Third-Party Services" means any external services, platforms, or providers integrated into or linked from the App, including but not limited to backend infrastructure providers, translation services, and real-time communication providers.

• "Prohibited Content" means any content that violates these Terms, applicable law, or the rights of any person, as further described in Section 11.

• "Intellectual Property Rights" means all patents, copyrights, trademarks, trade secrets, moral rights, and any other proprietary or intellectual property rights existing under applicable law.

3. Eligibility and Age Requirements

The App is intended exclusively for users who are at least 18 years of age. By creating an Account or using the Services, you represent and warrant that you are at least 18 years old, that you have the legal capacity to enter into a binding agreement, and that your use of the Services does not violate any applicable law or regulation in your jurisdiction.

We do not knowingly permit persons under the age of 18 to access or use the Services. If we become aware that a user is under 18, we will terminate their Account and delete associated data in accordance with our Privacy Policy. If you believe a minor is using the App, please contact us immediately at the details provided in Section 24.

Users located in jurisdictions where accessing social platforms or communication applications is restricted or regulated by law bear sole responsibility for ensuring compliance with applicable local laws prior to registration and use.

4. Account Registration and Security

4.1 Registration Requirements

To access the full functionality of the App, you must register for an Account by providing accurate, current, and complete information, including a valid email address, a unique username, your age, and your gender. You agree to maintain and promptly update your Account information to ensure it remains accurate and complete at all times.

4.2 Account Credentials

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You agree not to share your credentials with any third party, not to use another user's Account without authorization, and not to create multiple Accounts for deceptive or abusive purposes.

4.3 Unauthorized Access

You must notify us immediately upon becoming aware of any unauthorized access to or use of your Account. We shall not be liable for any loss or damage arising from your failure to comply with this security obligation. HippolyteDev reserves the right to suspend or terminate any Account we reasonably believe has been compromised, accessed without authorization, or used in violation of these Terms.

4.4 Account Accuracy

Providing false information during registration, including a false age, constitutes a material breach of these Terms and may result in immediate suspension or termination of your Account without notice.

5. Public Profile and User Identity

Upon registration, you will create a public profile consisting of your chosen username, age, and gender ("Public Profile"). You acknowledge and agree that your Public Profile will be visible to other users of the App, and accordingly you should not include personal information in your username or profile that you are not comfortable sharing publicly.

You must not create a username that impersonates any person or entity, including other users or public figures; is offensive, harassing, or discriminatory; infringes on any trademark or intellectual property right; or is misleading or deceptive in any manner.

HippolyteDev reserves the right to require you to change your username or other profile details if we determine, in our sole discretion, that they violate these Terms or are otherwise inappropriate.

6. Permitted Use of the App

Subject to your compliance with these Terms, HippolyteDev grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, and use the App on a single Android device you own or control, solely for your personal, non-commercial use.

The App and its Services are provided for lawful social interaction and communication between users. You may use the App to create and manage your public profile, interact with other users through available communication features, use the language translation functionality to process and translate content you generate, and purchase and use Tokens to access premium features.

This licence does not grant you any rights in the App's underlying software, code, algorithms, databases, or content other than as expressly stated in these Terms.

7. Prohibited Conduct

You agree that you will not, under any circumstances, use the App or Services to:

• Post, transmit, or share any content that is unlawful, abusive, defamatory, obscene, pornographic, harassing, threatening, discriminatory, or otherwise objectionable.

• Engage in bullying, harassment, stalking, or any form of targeted abuse against other users.

• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.

• Distribute spam, unsolicited commercial messages, phishing attempts, or any form of automated or scripted communication.

• Upload or transmit malware, viruses, trojans, ransomware, spyware, or any other malicious or destructive code.

• Attempt to gain unauthorized access to any part of the App, its infrastructure, servers, databases, or the accounts of other users.

• Scrape, crawl, or otherwise extract data from the App by automated means without our prior written consent.

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App or any part thereof.

• Interfere with or disrupt the integrity or performance of the App or the data contained therein.

• Use the App to facilitate illegal transactions, money laundering, or any other criminal activity.

• Circumvent, disable, or otherwise interfere with security-related features of the App.

• Collect, harvest, or store personal data of other users without their explicit consent.

• Create Accounts through automated means or under false pretences.

• Violate any applicable local, national, or international law or regulation.

Violation of any of the above may result in immediate termination of your Account and access to the Services, without prejudice to any legal remedies available to HippolyteDev.

8. User Content: Licence, Representations, and Responsibilities

8.1 Licence Grant

By submitting, uploading, capturing, or otherwise providing User Content through the App, you grant HippolyteDev a worldwide, royalty-free, non-exclusive licence to use, reproduce, process, adapt, and transmit your User Content solely to the extent necessary to operate and provide the Services to you and other users. This licence is limited to the purpose of delivering the functionality of the App and does not entitle HippolyteDev to commercialize your content.

8.2 Your Representations

You represent and warrant that: (a) you own or have all necessary rights, licences, and permissions to submit the User Content; (b) the User Content does not infringe any third-party Intellectual Property Rights, privacy rights, or other legal rights; (c) the User Content does not contain any Prohibited Content; and (d) you have obtained all necessary consents from any identifiable individuals depicted or recorded in the User Content.

8.3 Your Responsibility

You are solely responsible for your User Content and any consequences arising from its submission. HippolyteDev does not endorse, verify, or take responsibility for the accuracy, completeness, or appropriateness of any User Content submitted by users. We are not obligated to monitor User Content but reserve the right to do so and to remove content that violates these Terms.

9. Device Permissions

9.1 Camera, Microphone, and Media Storage

Certain features of the App require access to your device's camera, microphone, and/or media storage. These permissions are requested solely to enable user-initiated actions, such as capturing images, recording audio, or uploading media content. We do not access your camera or microphone in the background or without your initiation of a relevant feature.

9.2 Push Notifications

The App may request permission to send you push notifications for the purpose of delivering app-related messages, including service updates, account notices, and operational communications. You may grant or revoke notification permissions at any time through your device settings.

9.3 Revocation of Permissions

You may revoke any device permission at any time through your Android device settings. Please note that revoking certain permissions may result in the unavailability of features dependent on those permissions. We are not liable for any limitation in functionality resulting from your modification of device permissions.

10. Messaging and Real-Time Communication Features

The App includes messaging or communication features that allow users to interact with one another in real time. You acknowledge that all communications made through the App's messaging features are subject to these Terms, including but not limited to Section 7 (Prohibited Conduct) and Section 8 (User Content).

You must not use the messaging features to solicit other users for commercial purposes, distribute unsolicited content, engage in any form of harassment, or transmit any content that is unlawful. HippolyteDev is not a party to communications between users and is not responsible for the content of any messages sent or received through the App.

We do not access, monitor, or remove private messages between users, as communications are stored locally on users' devices. Users may report abusive conduct using the in-app reporting tool or block other users directly from their profile. Upon receiving a report, HippolyteDev reserves the right to suspend or permanently terminate the reported user's account.

11. Language Translation Functionality

The App includes a translation feature that allows users to translate messages they have received from other users. HippolyteDev does not guarantee the accuracy or reliability of translations. Translations are provided as a convenience tool only and should not be relied upon for legal, medical, financial, or other professional purposes.

12. Tokens and In-App Purchases

12.1 Freemium Model

Kina operates on a freemium model. Certain features and content within the App are accessible free of charge, while others may require the purchase and use of Tokens. Tokens are consumable virtual items and are not real currency.

12.2 Purchase of Tokens

Tokens are purchased exclusively through Google Play Billing. By purchasing Tokens, you agree to the applicable terms and conditions of Google Play, including Google's payment and refund policies. HippolyteDev does not process payment information directly and has no access to your full payment card details.

12.3 No Real-World Value

Tokens have no monetary value, cannot be redeemed for cash or any real-world equivalent, are not transferable to other users, and do not constitute property or assets for any legal purpose. HippolyteDev makes no representation that Tokens will retain their availability, functionality, or access to associated features indefinitely.

12.4 No Refunds

All Token purchases are final and non-refundable, except where required by applicable law or Google Play's refund policies. If you believe you are entitled to a refund under applicable law, please contact Google Play's support or HippolyteDev at the contact details in Section 24.

12.5 Changes to Features and Pricing

We reserve the right to change the price of Tokens, modify the features accessible through Tokens, introduce new purchasable items, or discontinue certain features at any time. Where we discontinue a feature for which Tokens were required, we may, at our discretion, offer alternative access or compensation but are not legally obligated to do so unless required by applicable law.

13. Third-Party Services

The App integrates with third-party service providers to deliver core functionality, including backend infrastructure and hosting, real-time communication infrastructure, database services, language translation services, push notification delivery services, and payment processing through Google Play Billing. These providers act as data processors or service providers on our behalf and are contractually required to handle data only in accordance with our instructions and applicable law.

HippolyteDev is not responsible for the availability, performance, security, or content of any Third-Party Services. Your use of features dependent on Third-Party Services is subject to those providers' own terms and conditions. We encourage you to review the terms and privacy policies of any third-party services you interact with in connection with the App.

The App may contain links to external websites or resources. Such links do not constitute an endorsement by HippolyteDev, and we accept no responsibility for their content or any loss or damage that may arise from your use of them.

14. Intellectual Property Rights

14.1 Ownership

HippolyteDev retains all rights, title, and interest in and to the App, its design, software, code, user interface, graphics, trade marks, trade names, and all other content and materials comprising or forming part of the Services, excluding User Content. Nothing in these Terms shall be construed to transfer any Intellectual Property Rights of HippolyteDev to you.

14.2 Restrictions

You agree not to copy, reproduce, distribute, create derivative works of, publicly display, decompile, reverse engineer, or otherwise exploit any part of the App or its content for any purpose not expressly permitted by these Terms. You may not remove or alter any copyright, trade mark, or other proprietary notices from any part of the App.

14.3 Feedback

If you submit feedback, suggestions, ideas, or other input regarding the App ("Feedback"), you acknowledge that such Feedback is non-confidential and grant HippolyteDev an irrevocable, worldwide, royalty-free right to use and incorporate such Feedback into the App or Services without any obligation to you.

15. Privacy and Data Protection

HippolyteDev processes your personal data in accordance with its Privacy Policy, available within the App and at our designated website. The Privacy Policy explains what data we collect, how we use it, how long we retain it, and what rights you have in relation to it, including rights applicable under the EU General Data Protection Regulation (GDPR), UK GDPR, and other applicable data protection regimes.

By using the App, you acknowledge that you have read and understood our Privacy Policy and consent to the processing of your personal data as described therein. To the extent permitted by applicable law, your continued use of the Services following any changes to the Privacy Policy constitutes your acceptance of those changes.

Device permissions, including camera, microphone, and media storage, are requested solely to enable user-initiated features and not for surveillance or background data collection. Push notification identifiers are used exclusively to deliver app-related communications.

16. Content Moderation and Enforcement

16.1 Our Rights

HippolyteDev reserves the right, at its sole discretion and without obligation, to review, monitor, moderate, remove, or restrict access to any User Content or account activity that we believe violates these Terms, infringes any third-party rights, or is otherwise harmful, offensive, or unlawful. We may exercise these rights without prior notice to you.

16.2 Reporting Mechanism

If you encounter content or conduct on the App that you believe violates these Terms or applicable law, you may report it to us using available in-App reporting tools or by contacting us directly at the details in Section 24. We will review reports in good faith and take action where warranted.

16.3 No Obligation to Monitor

We do not undertake a general obligation to monitor all User Content. Our exercise of the right to moderate content in any particular instance does not create an obligation to monitor content on an ongoing basis or create liability for any failure to moderate in other instances.

17. Account Suspension and Termination

17.1 By HippolyteDev

We may suspend, restrict, or permanently terminate your Account and access to the Services, with or without notice, for any of the following reasons: breach of these Terms; conduct that is harmful, abusive, or unlawful; repeated violation of community standards; fraudulent or deceptive activity; or any reason we determine in our reasonable discretion to be necessary to protect the integrity, security, or reputation of the App or the safety of other users.

17.2 By You

You may delete your Account at any time by using the in-App account deletion feature, where available, or by contacting us at the details in Section 24. Account deletion is subject to our data retention procedures as outlined in our Privacy Policy.

17.3 Effect of Termination

Upon termination of your Account, your right to use the App and Services will cease immediately. Any unused Tokens at the time of termination will be forfeited, except to the extent required otherwise by applicable law. Termination does not limit any rights or remedies available to HippolyteDev in respect of any prior breach by you.

18. Disclaimers and Warranties

THE APP AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. HIPPOLYTEDEV SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components; that translations generated by the App will be accurate or reliable; that User Content submitted by other users will be lawful or appropriate; or that the App will meet your requirements or expectations.

Nothing in this Section shall exclude or limit any warranty implied by law that cannot lawfully be excluded or limited. In particular, nothing in these Terms shall affect any statutory consumer rights you may be entitled to under applicable mandatory law.

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HIPPOLYTEDEV, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITY, OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIPPOLYTEDEV'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO HIPPOLYTEDEV FOR TOKENS OR PAID FEATURES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) FIFTY EUROS (EUR 50).

Nothing in these Terms shall exclude or limit HippolyteDev's liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, any liability that cannot be excluded or limited under applicable mandatory consumer law, or any other liability that cannot be excluded by law.

20. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless HippolyteDev and its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of or access to the App and Services; (b) your User Content; (c) your breach of these Terms; (d) your violation of any third-party right, including any intellectual property, privacy, or publicity right; or (e) your violation of any applicable law or regulation.

HippolyteDev reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defence in such matters. You must not settle any such claim without HippolyteDev's prior written consent.

21. Governing Law and Dispute Resolution

21.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

21.2 Jurisdiction

Subject to Section 21.3, both parties submit to the exclusive jurisdiction of the courts of France to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation.

21.3 Consumer Rights

If you are a consumer resident in the European Union or in any jurisdiction that affords mandatory consumer protection rights, you may also have the right to bring proceedings before the courts of your country of residence or to make use of any applicable online dispute resolution platform, including the EU Online Dispute Resolution platform accessible at https://ec.europa.eu/consumers/odr. Nothing in these Terms is intended to deprive you of such rights.

21.4 Informal Resolution

Before initiating any formal legal proceeding, we encourage you to contact us at the details provided in Section 24 to attempt to resolve the dispute amicably. We will make reasonable efforts to address your concerns within thirty (30) days of receiving written notice.

22. Force Majeure

HippolyteDev shall not be liable for any delay or failure to perform any obligation under these Terms to the extent that such delay or failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemic or pandemic, war, terrorism, civil unrest, government action, power or infrastructure failures, cyberattacks, or failures of third-party service providers.

If a force majeure event occurs, we will notify you as soon as reasonably practicable and will resume performance of our obligations as soon as reasonably possible once the force majeure event has ceased.

23. Severability and Waiver

23.1 Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from the remainder of these Terms, which shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.

23.2 Waiver

HippolyteDev's failure to enforce any provision of these Terms or to exercise any right or remedy available to it shall not constitute a waiver of that provision, right, or remedy. No waiver by HippolyteDev of any breach of these Terms shall be deemed a waiver of any subsequent breach.

25. Amendments to These Terms

HippolyteDev reserves the right to modify, update, or replace these Terms at any time. When we make changes, we will post the revised Terms within the App and update the "Last Updated" date at the top of this document. Where required by applicable law or where changes are material, we will provide additional notice, which may include in-App notifications or email notice to your registered address

Your continued use of the App following the publication of any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue your use of the App and delete your Account. We encourage you to review these Terms periodically to stay informed of any updates.

In the event of a conflict between these Terms and any translated or localized version, the English language version shall prevail to the fullest extent permitted by law.

By using the Kina App, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
